Terms.

These terms govern your use of the Swell application and website, provided by TOCLD. By using Swell, you agree to them.

YOUR USE OF THIS REAL TIME WEATHER GUIDANCE APPLICATION OR WEBSITE IS AT YOUR SOLE RISK. WEATHER DATA MAY NOT BE ACCURATE.

Forecasts are guidance

Swell summarizes forecast data and preferences. It is not emergency, navigation, rescue, medical, maritime, or life-safety advice. Conditions can change rapidly and observed surf can differ materially from a forecast. Check official warnings, local conditions, access rules, your ability, and appropriate safety equipment before entering the water. Never rely on Swell as your only source of information.

Subscriptions

Swell may offer auto-renewing subscriptions. The App Store purchase sheet shows the price, billing period, any trial, and applicable terms before you confirm. Payment is charged to your Apple Account. A subscription renews unless you cancel at least 24 hours before the end of the current period. You can manage or cancel in your Apple Account subscription settings. Available features and offers may vary by eligibility, region, or campaign.

Restoring purchases checks your Apple entitlement; it does not create a new charge. Except where law requires otherwise, Apple handles billing, cancellation, and refund decisions.

Acceptable use

You may use Swell for personal, lawful purposes. Do not interfere with the service, bypass access controls, scrape or resell data, overload providers, reverse engineer protected components, or use Swell in a way that violates another person’s rights or a data provider’s terms.

Availability and intellectual property

We may change, suspend, or discontinue features when needed for safety, provider availability, legal compliance, or product improvement. Swell’s design, software, copy, and branding belong to TOCLD or its licensors. Forecast and map data remain subject to their providers’ rights and attribution terms.

Disclaimers and liability

To the maximum extent permitted by law, Swell is provided “as is” and “as available,” without warranties of accuracy, availability, fitness, or non-infringement. TOCLD is not liable for indirect, incidental, special, consequential, or punitive loss, or for decisions made using a forecast. Nothing here excludes rights or liabilities that cannot legally be excluded.

Apple terms

Apple is not responsible for Swell or its support. Your App Store use is also subject to Apple’s applicable Licensed Application End User License Agreement and Media Services Terms and Conditions.
